The website is meant to be an Informational, Educational, Psychoeducational, and Instructional Health and Wellness Site. The information should never replace professional treatment, advice, and/or care. The mental health care information on the site should not be attempted without the guidance and expertise of a licensed professional.
Purpose:
The purpose of this site is to provide information on at home health and wellness and self-improvement solutions for those who wish to learn about health and wellness or practice skills acquired in therapy or life coaching through the approaches, objectives, and interventions described.
Content Text:
The content on the website is knowledge the website creator and administrator has acquired through education, training, research, and continued learning. Much of the website content was written with the assistance of language learning models of artificial intelligence software created with inquisitive prompts and keywords. Information provided by such software is reviewed for accuracy, reliability, and validity by the website administrators before publication.
Some of the content includes information and practices that have no or little scientific evidence to support the efficacy of such practices or empirically supported reliability, accuracy, validity. I do share the content regardless of evidence because of the popularity of the content. That popularity may be due to a number of factors including placebo effect or one of several logical fallacies, an appeal to antiquity, an appeal to tradition, and an appeal to popularity.

The Health Insurance Portability & Accountability Act of 1996 (HIPAA) is a federal program that requires that all medical records and other individually identifiable health information used or disclosed by us in any form, whether electronically, on paper, or orally, are kept properly confidential. For Psychotherapists this requires little change from the practice of confidentiality that has been required of our profession prior to HIPAA. In general, the HIPAA Act gives you, the client or patient, significant new rights to understand and control how your health care information is used. HIPAA provides penalties for covered entities that misuse personal health information.
As required by HIPAA, I have prepared this explanation of how I am required to maintain the privacy of your health information and how I may use and disclose your health information. Please note that, for the practice of psychology, these HIPAA requirements compliment rather than add any significant change to the normal and usual practice as regards record keeping and confidentiality. I may use and disclose your medical records only for each of the following purposes: treatment, payment and healthcare operations.
Treatment means providing, coordinating, or managing health care and related services by one or more health care providers. An example of this would be performing psychotherapy in this office, or making a referral to another health care provider for additional evaluation or treatment.
Payment means such activities as obtaining reimbursement services, confirming insurance coverage, billing or collection activities, and utilization review for managed care coverage and approval and/or at the request of a third party payer for your treatment (your insurance company). An example of this would be sending a bill for your psychotherapy visit to your insurance company, electronically, by mail, or by fax, sending the necessary clinical information for your insurance company to approve more sessions for coverage for you.
Health care operations include the business aspects of running a practice, such as conducting quality assessment and improvement activities, auditing functions, cost-management analysis, and customer service. An example would be an internal quality assessment review. I may also create and distribute de-identified health information by removing all references to any and all individually identifiable information. I may contact you to provide appointment reminders or information about treatment alternatives or other health related benefits and services that might be requested by or be of interest to you.
Any other uses and disclosures will be made only with your written authorization. You may revoke such authorization in writing and I am required to honor and abide by that written request, except to the extent that I have already taken actions relying on your prior written authorization to take such actions. You have the following rights with respect to your protected health information, which you can exercise by presenting a written request to your psychotherapist.
The right to request restrictions on certain uses and disclosures of protected health information, including those related to disclosures to family members, other relatives, close personal friends, or any other person identified by you. I am, however, not required to agree to a requested restriction if Vermont law or Federal law indicates that to do so would be a violation of Duty to Warn Statutes of person or property, violation of mandated reporting of known abuse of a minor or child, or violation of mandated reporting of known abuse of an elderly or incapacitated person. As a psychotherapy client/patient you own the privilege of confidentiality, and no information, including your presence in therapy or the fact that you are a client, will be disclosed without your specific written permission in a release of information request.
Psychotherapy has traditionally always been more restricted in its mandated legal and ethical protection of your protected health information. HIPAA regulations do not affect any previous safeguards to your privacy as a patient, except in certain cases to strengthen them. The right to reasonable requests to receive confidential communications of protected health information from us by alternative means or at alternate locations. – The right to inspect and copy your protected health information. – The right to amend your protected health information. – The right to receive an accounting of disclosures of protected health information. – The right to obtain a paper copy of this notice from us upon request.
I am required by law to maintain the privacy of your protected heath information and to provide you with notice of our legal duties and privacy practices with respect to protected health information. This notice is effective as of September 1st, 2020 and I am required to abide by the terms of the Notice of Privacy Practices currently in effect. I reserve the right to change the terms of my Notice of Privacy Practices and to make the new notice provisions effective for all protected health information that I maintain. I will post and you may request a written copy of a revised Notice of Privacy Practices from my office.
You have recourse if you feel that your privacy protections have been violated. You have the right to file a written complaint with the Department of Health and Human Services, or the Office of Civil Rights, about violations of the provisions of this notice or the policies and procedures of my practice. If you are a client, posting to any public blog, community, or message board administered and hosted by the Site, you may possibly be surrendering your confidentiality and anonymity and your status as a client of James Fitzgerald Therapy.
By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
- defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others

Clients of James Fitzgerald Therapy who complete assessments, surveys, questionnaires, tools, trackers, and journals on the subscription areas of this Site are protected by HIPAA, CFR 42, Federal and State regulations, and Professional organization ethical standards of practice. The information you provide through the assessments and other data collection tools will not be shared, copied, distributed, transmitted, publicly displayed, publicly performed, reproduced, edited, translated and/or reformatted; and your name will not be published in connection with your assessment results and submission. Any records created by therapy clients on this site are considered a part of the clinical record and may be transferred to their Therapy Notes LLC client portal for their additional confidentiality protection.
International Users
The Service is controlled, operated and administered by James Fitzgerald Therapy from our offices within the USA, the state of Vermont in Chittenden County. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Content accessed through https://www.strengtheningyourconsciousself.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification

Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties.
The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees.
The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted.
THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER.
Further, unless both you and James Fitzgerald Therapy PLLC agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Termination/Access Restriction

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Georgia and you hereby consent to the exclusive jurisdiction and venue of courts in Georgia in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency contractor or subcontractor relationship exists between you and James Fitzgerald Therapy PLLC as a result of this agreement or use of the Site, to the exclusion of clients of James Fitzgerald Therapy and Strengthening Your Conscious Self © 2022. Rates of services for clients will be kept current on the Site. James Fitzgerald Therapy’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of James Fitzgerald’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by James Fitzgerald Therapy with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and James Fitzgerald Therapy with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and James Fitzgerald Therapy with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
