The masterclasses, courses, modules, and activities hosted on this website are pieces of a broader program created by the site administrator James Fitzgerald, MS, NCC, LCMHC, the “professional” called “Strengthening Your Conscious Self” © 2022, all rights reserved. The lessons in the program are adapted from other books, materials, and sources. The content has been curated from many other authors, content creators, and publishers. I invite you to check out other learning materials listed on the resources and bibliography pages. Material and elements are integrated from many scientific fields, therapeutic approaches, and philosophies.

The following is a standard legal form of disclaimer and waiver of liability and has been customized to meet the specific needs or requirements of this program. This waiver will cover the necessary legal and ethical ground for compliance to laws and statutes. It’s crucial to ensure that I am safeguarded against any liabilities while also being clear and transparent with my clients. Being explicit about the limitations of the course is especially important so that you will have appropriate expectations and make informed decisions about your mental health. As a mental health professional, I understand the profound impact that psychological well-being has on overall health. Creating a safe environment for exploration and learning is an essential aspect of any psychoeducational offering. By setting clear boundaries and expectations through documents like this waiver, I am contributing to the creation of such a safe space.


Material and Content Organization

First, allow me to explain the way I have organized the courses. I have chosen to present each of the professional’s material and content separately, in order of topics. In this way, you have the chance to learn about mindfulness, emotional intelligence, critical thinking, distress tolerance, parts work, self therapy, internal family systems, interpersonal effectiveness, and conflict resolution from several perspectives. It is my hope that one or more of the perspectives will resonante with you.

Second, It is well known that we as humans learn better and retain knoweledge when several methods are utilized. You are more likely to commit that event or experience to your memory when:

  • Something you are learning elicits an emotional response, that emotion can be fear, anxiety, sadness, joy, disgust, or anger.
  • Something is presented in novel ways, and engaging enough without being over stimulating, and you are genuinely interested in knowing more about it.
  • You are presented with the information several times, in different media, from different presenters, and from different perspectives.
  • Information is presented in a way that is easy to comprehend, easy to learn, and not difficult to follow along with the flow of the presentation.
  • You are asked to reflect and write responses after each lesson, or if you are learning by doing, “hands on” learning and practical application. 
  • There are no tests or quizzes, and there is active discussion, processing. or reflecting to measure learning objectives.
  • You put that education into practical application as soon after you learn it as possible, and keep practicing, making it a daily habit.

Third, and finally, it is outside the scope of this course and this administrator’s realm of knowledge and scope of practice, but there other factors that influence how well you retain, remember, and recall information, that includes daylight, sleep, nutrition, medication, vitamins, supplements, water, and exercise.

This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the parties have been advised of the possibility of such damages). By choosing to participate in this psychoeducational course, you expressly waive any claims against the facilitators, authors, producers, and any affiliated entities for any liability arising out of the use or misuse of the information presented in this course. You also acknowledge that you are participating in this course voluntarily and that you assume any and all risks associated with such participation.


Mental Health and Emotional Safety

You are solely responsible for your actions and interpretations arising out of the information presented in this course and should exercise sound judgment and consult with qualified healthcare providers for diagnosis and treatment when appropriate. The authors and content creators – including the administrator of this course – discuss matters and behaviors that may activate parts of your subconscious and could possibly trigger any number of sympathetic nervous system responses. The authors and content creators discuss self harming actions, eating disorders, abuse, and intimate partner conflicts in order to provide context and examples. Inevitably, you might feel triggered by the materials or content, either through memories of trauma, and/or by the spiritual nature of some of the approaches. If you experience any overwhelming distress or the material does not resonate with you, please stop until we have had a chance to process the reactions and your concerns.


Governing Law and Jurisdiction

Any claim relating to the course materials shall be governed by the laws of the State in which the course is being offered, without regard to its conflict-of-law principles. The attendees agree to submit to the personal jurisdiction of said courts for any related disputes.


Permissions:

The materials and content are used with permission of the creators, authors, and publishers, and in addition to using the materials privately with my therapy clients, they are also a part of the health and wellness program “Strengthening Your Conscious Self.” I am only allowed to share the material with my clients. Some of the content is copyright protected. All rights reserved. No part of the publications may be reproduced, stored in a retrieval system, or transmitted, in any form or by any means, electronic, mechanical, photocopying, recording, or otherwise, without the written prior permission of the author.


Personal Use:

The materials are for your personal use only. This agreement applies to many of the lessons and exercises, as well as some modules and courses. Lessons and exercises are described in Quenza as activities. Courses and modules are described in Quenza as pathways. The sections on this site listed in each course are also referred to as modules.


Attestation:

In agreeing to the terms and conditions, you attest that you will not download, print, distribute, or electronically share the content from this master class. The material is generously provided to you by the site administrator and course presenter. The only exception to the copyright rule are your personal thoughts written in reflection exercises you complete. You may of course, download or print the completed journal entries if you choose.
